By accessing or using StoryHawk's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all users of the platform, including free trial and paid subscribers.

2. Service Description

StoryHawk provides a Google Top Stories tracking and analytics platform for news publishers. Our services include:

  • Real-time tracking of article rankings in Google Top Stories
  • Competitor monitoring and analysis
  • Performance analytics and historical data
  • Alerts and reporting features

3. User Accounts

Account Registration

To use our services, you must create an account. You agree to:

  • Provide accurate and complete information
  • Keep your login credentials secure and confidential
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

Eligibility

You must be at least 18 years old and have the legal authority to enter into these terms. If using on behalf of an organization, you represent that you have authority to bind that organization.

4. Subscriptions and Payments

Subscription Plans

We offer various subscription plans with different features and keyword limits. Plan details and pricing are available on our website and may be updated from time to time.

Billing

  • Subscriptions are billed on a recurring monthly basis
  • Payments are processed securely through Stripe
  • Prices exclude VAT/taxes, which will be calculated at checkout based on your location
  • We reserve the right to modify pricing with 30 days notice

Free Trial

New users may be eligible for a free trial period. Trial terms are specified during signup. After the trial ends, you will need to subscribe to continue using the service.

Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing period, and you will retain access until then.

Refunds

Due to the nature of our data services, refunds are generally not provided for partial billing periods. However, we may consider refund requests on a case-by-case basis for exceptional circumstances.

5. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose
  • Attempt to harm, disrupt, or gain unauthorized access to our systems
  • Reverse engineer, decompile, or attempt to extract our source code
  • Use automated tools to scrape or extract data beyond normal API usage
  • Resell or redistribute our services without authorization
  • Interfere with other users' access to the service

6. Intellectual Property

StoryHawk and its original content, features, and functionality are owned by StoryHawk and are protected by international copyright, trademark, and other intellectual property laws.

License Grant

We grant you a limited, non-exclusive, non-transferable license to access and use our services for your internal business purposes during your subscription term.

7. Your Data

You retain ownership of the data you input into our platform (keywords, websites, etc.). By using our services, you grant us a license to:

  • You retain ownership of your account data and configurations
  • You grant us license to process your data to provide the services
  • We recommend maintaining your own backups of critical business data

8. Third-Party Services

Our platform integrates with third-party services (Google, Stripe, etc.). Your use of these services is subject to their respective terms. We are not responsible for third-party service availability or accuracy of data from external sources.

9. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind:

  • We do not guarantee uninterrupted or error-free service
  • We do not guarantee specific search ranking results or outcomes
  • Third-party data accuracy depends on external providers

10. Limitation of Liability

To the maximum extent permitted by law, StoryHawk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless StoryHawk and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service or violation of these terms.

12. Termination

We may suspend or terminate your access to the service at any time for:

  • Violation of these terms
  • Non-payment of subscription fees
  • Abusive or harmful behavior
  • At your written request

13. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of material changes via email or through the platform. Continued use after changes constitutes acceptance of the new terms.

14. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which StoryHawk operates, without regard to conflict of law principles.
